Location-Based Services

Nearstory collects a visitor's geolocation data through the Nearstory app for purposes of offering users relevant audio content. Geolocation data consists of general location information based on latitude and longitude.

We reserve the right to refuse service to anyone for any reason at any time and may, but have no obligation to, remove content that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.

Children

Children should always get permission from their parents before using the Nearstory app as it can contain material not suitable for children. Nearstory offers tool more specifically filters that make our service more stable for children. Children should also get permission from their parents before sending any information about themselves (such as their names, email addresses, and phone numbers) via the web or mobile device, to Nearstory or to anyone else. Nearstory does not knowingly allow anyone under the age of 13 to provide any personally-identifying information to Nearstory. If you are under 13, please do not attempt to register for any Neastory Services or provide any information about yourself.

13-18: You must be at least 18 years old in order to Submit any User Materials on or through the Nearstory Services, register for the Nearstory Services. Visitors between the ages of 13 and 18 must obtain permission from their parents or guardians before registering for email newsletters or otherwise sending any personally-identifying information.

Email Lists

You may be given the opportunity to sign up for Nearstory email. If you decline, no data will be sent. If you accept, the email address you provide will be added to our email list. We believe strongly in protecting your inbox. We hope that you will feel included enough in our company that you will look forward to these emails and we will do our best to keep you engaged.

We aim to keep our email low volume (usually no more than 4 messages a month), and is generally limited to announcements, updates to our app, or significant new product releases.

We do not sell or otherwise provide any of our email list to third-parties, with the exception of the company that provides the mailing list services.

Gathering of Information

Nearstory collects information you directly give us. For example, we collect information about you when you participate in any interactive features of the Service, fill out a form, give feedback, ideas or submissions about the Service, communicate with us via third party social media sites, request customer support or otherwise communicate with us. If you choose not to provide certain information, we may not be able to provide the Service to you or certain features of the Service may be unavailable or work differently. When you access or use our Service, we automatically collect certain information about you. This information includes:

  • User’s listening activity, including audio content that a user accesses, audio segments that a visitor skips and shares, the location where the user listens to the content, audio pieces that a visitor marks as favorite, listening times and frequency and date and time of visit. Information gathered contain some or all of the following information:
    • IP address, Device type and unique device identifier (for users of Nearstory App) and other technical information about your device, system, app version and application software.
    • General location information (based on unique device identifier, IP address or latitude and longitude).
    • The date and time of the visit.
    • The path taken through the Nearstory Services, including any "favorites" selected by the visitor, as well as patterns in the paths taken by visitors.
    • Other content preferences
    • The browser and operating system being used.
    • A list of files downloaded or viewed.
    • The amount of time spent listening to/viewing media files.
    • Any errors encountered.
  • Nearstory may share this information with content producers that are on the system. This data does not personally identify our visitors. We do this to help them measure impact and better understand user listening habits. It also helps them sell to potential partners and sponsors so that they can continue making great content.

Use of Information

Nearstory uses the information it gathers (a) to provide requested products and services, (b) to identify visitors when Nearstory publishes material they submitted, and (c) for internal purposes and for marketing, fundraising, membership and communications purposes of Nearstory and Nearstory content partners.

Nearstory uses access logs, content preferences, information about visitor listening activity, cookies, web beacons, and third-party analytics data to analyze use of the Nearstory Services, offer interactive features, and personalize the Nearstory Services, such as by recalling visitor information so that the visitor does not have to re-enter it, offering content that may be of interest to the visitor, and displaying more relevant sponsorship messages. Nearstory and content partners may use information about listening activity and content preferences for internal purposes and for marketing, fundraising, membership and communications purposes.

Sharing Information

Nearstory may share with any third parties aggregated or anonymized information that does not personally identify its visitors. The use and disclosure of such information is not subject to restrictions under this Privacy Policy.

Nearstory may share with vendors, consultants and other service providers who need access to such information to carry out work on our behalf.

Any geolocation data and other location information collected through Nearstory Services that is used to offer relevant content to the user.

Nearstory also may share with sponsors and content producers information that does not personally identify our visitors, as described in this Privacy Policy

Nearstory will release visitor information when required to do so by law or when it believes it is necessary to protect Nearstory, Nearstory employees, Nearstory Content Partners, sponsors, service providers, the public, or others.

In connection with, or during negotiations of, any merger, sale of Nearstory assets, financing or acquisition of all or a portion of our business to another company; and with your consent or at your direction, including if we notify you through the Service that the information you provide will be shared in a particular manner and you provide such information.

If you do not consent to the collection, use or sharing of your personally-identifying information as described in this Privacy Policy, please do not provide that information. By providing your personally-identifying information, you are "opting in" to the collection, use and sharing described in this Privacy Policy.

Links to other Sites and Services

It is important to note that the Nearstory Services contain links to other sites, applications and services maintained by third parties that may not follow the same privacy policies as the Nearstory Services. For instance, clicking or tapping on the view website button found on the Nearstory info pages or any potential sponsorship acknowledgment will take you to an entirely different site, application or service. These sites, applications and services may use cookies, collect data, and use the data in ways that the Nearstory Services would not. Nearstory is not responsible for the privacy practices of, or any information or materials on, these other sites. Please visit these sites if you wish to review their privacy policies.

Promotional Communications

You may opt out of receiving promotional communications from Nearstory by following the instructions in those communications. If you opt out, we may still send you non-promotional communications, such as those about your account or our ongoing business relations.

Push Notifications and Alerts

With your consent, we may send push notifications or alerts to your mobile device.

Any changes to the Privacy Policy will be posted to this page, with an updated Effective Date noted at the top of the Privacy Policy; visitors to the Nearstory Services are responsible for reviewing the Privacy Policy for any changes before using, registering for or accessing the Nearstory Services. Use of the Nearstory Services constitutes consent to and acceptance of the Privacy Policy and Terms of Use in effect at the time of such use.
